Regulation outlining religious exemption guidelines on hold

Board to wait on attorney general

Regulation outlining religious exemption guidelines on hold

By M.K. Luther - mkluther@nvdaily.com

FRONT ROYAL -- Following the suspension of a recently passed regulation on religious exemption from compulsory attendance, the Warren County School Board is waiting for an opinion from the attorney general before taking any further action, according to school officials.

The board approved a regulation on March 11 outlining guidelines for the request and approval of religious exemptions.

Under the draft regulation, parents requesting an exemption would be required to submit a letter to the board, including an explanation of the religious beliefs and why state-approved alternatives, such as homeschooling, do not satisfy the family's needs. According to the regulation, the board also could consider how the parents' beliefs compared with other members of their religion and "whether the belief is merely a social response to changing times."

The Home School Legal Defense Association, a homeschool advocacy group based in Purcellville, issued an e-mail alert dated March 24 about the Warren County regulation. The alert called for members to contact the board and ask for the suspension of the regulation and the creation of a task force -- with homeschool parents -- to draft "a consensus policy."

According to Virginia state code, a school board can excuse from compulsory attendance "any pupil who, together with his parents, by reason of 'bona fide religious training or belief,' is conscientiously opposed to attendance at school."

The association did not respond to a request for comment, but posted a release on its Web site commending the board for the suspension.

After a barrage of complaints from concerned parents and conducting her own research, Board member Kimberly Athey requested the regulation be suspended during last Thursday's work session. Athey also requested that the board seek an opinion from Attorney General Ken Cuccinelli on the legality of the regulation.

Athey said many of the parents who contacted her already had approved religious exemptions, and were worried about "the risk that this policy may pose to them in being able to maintain" the religious exemption status.

Athey said that while the religious exemption law and homeschool law are "two distinct statutes," many parents believed the now-suspended religious exemption regulation could affect all parents who wish to exercise their rights regarding a child's education.

"Both of the communities are concerned about having their options restricted," Athey said. "Their concerns are that a board may refuse [a request] under this regulation."

"When the School Board decided to pass policy that seemed to contradict established judicial precedent and home schooling statutes in Virginia it definitely was a concern for me," parent Michelle Bodoh stated in a Tuesday e-mail. "Even though I am not registered under the religious exemption clause, I do educate my children at home. I was concerned that if the School Board could arbitrarily change Virginia statutes in [that] regard, what else might they change in regards to home education?"

The board will meet again on April 8 at 7 p.m. at the Warren County Government Center.
